CM Vijay Faces Legal Challenge as Madras HC Notice Sparks Debate

On Tuesday, 07 July 2026, the Madras High Court issued notice to Tamil Nadu’s Chief Minister and Tamilaga Vettri Kazhagam (TVK) founder C. Joseph Vijay for significant legal and political controversies challenging his election victory and electoral campaigns in the April 2023 Assembly polls in Perambur and Tiruchy East constituencies.

The High Court’s decision has caused significant political attention across Tamil Nadu. However, as per the legal experts the issuance of notice does not affect Vijay’s position as Chief Minister.

Election Petitions Admitted By Madras High Court

DMK candidate R.D. Sekar with two others, Dinesh and Lakshminarasimhan, filed the petitions against CM Vijay for his election victory in Perambur, whereas Inigo Irudayaraj challenged his victory in Tiruchy East.

The court found sufficient grounds to evaluate the allegations raised by the petitioners and has issued notices directing the CM and Election Commission of India (ECI) to reply in three weeks. 

However, the petitions only signify that the court has agreed to hear the case and thereby do not invalidate Vijay’s election or remove him from office.

Significant Allegation: Involvement of Children During Election Campaign

The central legal allegation included in the petition is involvement of children during election campaigns in the Perambur constituency. 

According to the petitioners, the minors were involved in the campaigning activities that are in violation of election norms, and through campaigns, the attempt is made to influence children for political purposes. 

The petitioners also submitted a DVD to the court having a video clip evidencing their claims. In the clip, the appeal is made by CM during his last election campaign speech at YMCA ground in Chennai on 21 April 2026, in which he said, ”This kind of an emotional appeal to children and involving them in electoral activities is not immoral but against the spirit of the Representation of the People Act, 1951.”

The Madras High Court headed by Justice V. Lakshminarayanan has considered these allegations and directed CM Vijay to submit his response. The petitioners have argued that these actions lead to violation of election regulations and guidelines and are against the ethical campaign standards.

However, CM VIjay’s legal team have denied all the allegations raised in the petitions and stated that the campaign fully complied with the applicable election laws and there is no legal violation, but the matter is still under judicial consideration to reach a final conclusion.

Role of Election Commission of India

The Election Commission of India (ECI) is a respondent in this case and has been directed by the Madras High Court to submit his response.

The commission is required to clarify whether any complaints relating to alleged campaign activities received during the elections and what actions or inquiries were taken at that time. These clarifications will assist the court in validating the allegations of the petitioners.

The Madras High Court’s routine notice to Tamil Nadu Chief Minister C. Joseph Vijay regarding an election petition is a standard legal procedure rather than an immediate threat to his governance. Yet, this situation highlights a broader truth about our material existence: even ordinary, routine responsibilities require constant justification, defense, and expenditure of energy.
