The Jammu and Kashmir administration has amended the J&K Family Pension-cum-Gratuity Rules, 1964 through S.O. 204. It is done by introducing a significant change in the duration of enhanced family pension payable after the death of a retired government employee. The amendment aims to provide greater clarity on how long eligible family members can receive enhanced pension benefits. It has also ensured uniform implementation across the Union Territory.

Issued by the Finance Department (Codes Division) under the powers conferred by Article 309 of the Constitution of India, the notification adds a second proviso below Note 4 of Rule 20 of the pension rules. The revised provisions came into effect upon their publication in the Official Gazette of Jammu and Kashmir.

What Is the New Rule Under J&K S.O. 204?

The amendment clearly defines the period for which the enhanced family pension will be payable when a government servant dies after retirement.

Under the revised rule, eligible family members will receive the enhanced family pension for:

  • A maximum of seven years from the date of the pensioner’s death, or
  • Until the deceased pensioner would have attained the age of 67 years,

whichever of these two conditions occurs earlier.

This clarification removes ambiguity regarding the duration of enhanced pension payments.

Who Will Be Affected by the Amendment?

The revised provision applies specifically to families of retired government employees who become eligible for enhanced family pension after the pensioner’s death.

The notification also clearly distinguishes between different categories of pension cases:

  • Pending family pension claims on the date of the notification will be decided under the newly amended rules.
  • Cases that were already settled before the publication of S.O. 204 will remain unchanged and will not be reopened.

This ensures that while ongoing cases benefit from the revised provisions, previously finalized pension decisions retain legal certainty.

  • If a retired government employee passes away after retirement, the family may receive the enhanced family pension.
  • However, the benefit will continue only up to seven years after the date of death or until the date on which the deceased would have turned 67 years of age, whichever comes first.
