A birth and a tumultuous childhood in an era of racial discrimination

Navanetham Pillai was born on 23 September 1941 in the Clarewood area of Durban, South Africa. His father Narainasamy Naidu was a bus driver, while his mother Santhama was a housewife. The financial condition of this family of Tamil origin was very simple.

South Africa was under the harsh system of apartheid during that period, where non-white communities were denied basic rights. Books, newspapers, and even radio were not available in Pillay’s home. Despite this, his parents prioritized education. With the help of scholarships from the local Indian community, the Durban City Council, and the university, he continued his studies. This education later became the cornerstone of his legal and human rights struggle.

The journey from studying law to practicing as an independent advocate

Pillai received her BA degree from the University of Natal in the year 1963 and LLB degree in 1965. While studying at the university, she also joined the Non-European Unity Movement. In the year 1965, he married Gabby Pillay. The couple has two daughters.

In 1967, she opened her independent law office in the province of Natal. She became the first woman to start her own legal practice in the province. Due to apartheid, no law firm was willing to employ her. In such a challenging environment, she chose to practice law independently.

The main focus of his advocacy was political activists and victims of apartheid. He highlighted the ill effects of torture and solitary confinement. In 1973, he played an important role in securing the right to legal counsel for political prisoners imprisoned on Robben Island. Among these prisoners was Nelson Mandela. In the mid-1970s, he also defended members of the Black Consciousness Movement in court.

From Harvard University to international recognition

To further strengthen her expertise in the legal field, Pillay pursued higher education. In 1982, she earned a Master of Laws (LLM) degree from Harvard University. Subsequently, in 1988, she obtained a Doctor of Juridical Science (SJD) degree, becoming the first South African to receive this degree from Harvard.

Her academic achievements and legal experience prepared her for significant responsibilities within the international justice system. Her struggle against apartheid also established her as a prominent voice on human rights issues.

From the High Court of South Africa to the Rwandan Tribunal

After the end of apartheid, in 1995, Pillai was appointed as an acting judge in the High Court of South Africa. She became the first non-white woman to be appointed to this position. In the same year, the United Nations General Assembly elected her as a judge of the International Criminal Tribunal (ICTR) for Rwanda. She served on the tribunal from 1995 to 2003 and was its president from 1999 to 2003. In the early years, she was its only female judge.

The verdict in the Jean-Paul Akayesu case on September 2, 1998, became a historic milestone in his career. For the first time, the International Criminal Tribunal convicted a person of genocide. The judgment also established that rape and sexual violence could be acts of genocide, depending on the circumstances and intent.

Underlining the significance of this verdict, Pillai had said, “Since ancient times, rape was considered as the spoil of war. Now it will be considered a war crime. We want to send a strong message that rape is no longer a trophy of war. ”

In 2003, she became a judge of the Appeals Chamber of the International Criminal Court (ICC) and held the post until August 2008.

A High Voice for Human Rights at the United Nations

On July 24, 2008, United Nations Secretary-General Ban Ki-moon nominated Pillai for the position of High Commissioner for Human Rights. On July 28, the General Assembly approved his nomination, and he assumed office on September 1, 2008. He served in this capacity until 2014. During his tenure, he raised issues of human rights violations in various crisis-affected regions, including Sri Lanka, Syria, and Gaza. He also worked to bring topics such as discrimination within the caste system and the rights of LGBTQI com fcmunities to the forefront of international discourse.

Advocating for justice from Palestine to Myanmar

From 2021 to 2025, Pillai chaired the United Nations Independent International Commission of Inquiry on the occupied Palestinian territory. Additionally, she serves as an ad hoc judge at the International Court of Justice in the genocide case brought by The Gambia against Myanmar. Her contributions to women’s rights also include co-founding the international organization Equality Now.

Important messages for international law

The Norwegian Nobel Committee, through its decision, has underlined the importance of the rule of international law at a time when wars and conflicts are escalating and international legal institutions are under political pressure and attacks. According to the committee, Pillay has made significant contributions towards ensuring accountability in cases of war crimes, crimes against humanity, and genocide.

Navi Pillay’s journey is the story of a girl born into an ordinary family who, despite apartheid and institutional discrimination, made justice her mission. Her journey from independent advocacy to international tribunals and the United Nations is proof that courage, education, and an unwavering commitment to human rights can give a new direction to the global justice system. The 2026 Nobel Peace Prize is a recognition of her long struggle and dedication to international law.
